Acceptance of terms
By accessing exploresathi.com or any ExploreSathi Digital property, you agree to these Terms of Service and our Privacy Policy. If you are entering into a client agreement or statement of work, those documents take precedence for the specific engagement.
Our services
ExploreSathi Digital provides software development, design, consulting, and related digital services. Scope, deliverables, timelines, and fees for paid work are defined in separate proposals, contracts, or statements of work signed by both parties.
Acceptable use of the website
When using our website, you agree not to:
- Attempt to gain unauthorised access to our systems or data.
- Use automated means to scrape, overload, or disrupt the site without permission.
- Upload malicious code or content that infringes third-party rights.
- Misrepresent your identity or affiliation with ExploreSathi.
Intellectual property
Unless otherwise agreed in writing, all content on this website — including text, visuals, code samples, and branding — is owned by ExploreSathi Digital or its licensors and protected by applicable intellectual property laws.
For client projects, ownership of deliverables is specified in the project agreement. Pre-existing tools, frameworks, and general know-how remain our property.
Client responsibilities
Clients are responsible for providing timely feedback, accurate requirements, necessary access, and content needed for project delivery. Delays caused by missing inputs may affect timelines and are not our liability unless otherwise agreed.
Payment & refunds
Fees, invoicing schedules, and payment methods are set out in individual agreements. Unless stated otherwise, invoices are due within the period specified on the invoice. Deposits and milestone payments are generally non-refundable once work has commenced, except where required by law or explicitly stated in your contract.
Warranties & disclaimers
We warrant that services will be performed with reasonable skill and care. Except as expressly stated in a signed agreement, our website and services are provided "as is" without warranties of any kind, whether express or implied, including merchantability or fitness for a particular purpose.
Limitation of liability
To the fullest extent permitted by law, ExploreSathi Digital shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our aggregate liability arising from any claim relating to our services shall not exceed the fees paid by you for the specific engagement giving rise to the claim during the twelve months preceding the claim, unless a different cap is set in your contract.
Termination
Either party may terminate an engagement according to the termination clause in the applicable agreement. We may suspend or terminate website access for violations of these terms. Provisions that by nature should survive termination — including payment obligations, IP terms, and liability limits — will remain in effect.
Governing law
These terms are governed by the laws of India, without regard to conflict-of-law principles. Disputes shall be subject to the exclusive jurisdiction of the courts of India, unless otherwise agreed in a signed client contract.
Changes to these terms
We may update these terms from time to time. The "Last updated" date at the top of this page indicates the latest revision. Continued use of the website after changes constitutes acceptance of the revised terms.
